We beg to refer to the letter from your Department
dated the 12th May last and to paragraph 2 of the copy despatch

of the Governor dated the 26th April 1938 enclosed with that
letter.
We would also refer to the second paragraph of our
letter of the 13th May last.

As the Record has now been printed, we have enquired
of Mr. Kenelm Preedy whether there are any particular points
which he desires to be dealt with, especially in the instructions
which we are to receive from Hong Kong, and Mr. Preedy states that
there are none, but he wishes us to inform you that, when our
instructions have been received from the Colony and have been
considered by him and by the Attorney-General who is taking the
Leading Brief for the Respondent, if there arises any point upon
which special instructions are desired, we will request you to
cable to the Colony therefor.

In the meantime, we have sent Instructions to Mr.
Preedy to prepare a draft Case for the Respondent and, as it is
hoped that this appeal will be heard immediately after the Long
